The Heller Case

This is probably the hilight phrase of the decsion:


"Quite significantly the Heller Majority observed the the Constitution does not grant a right to bear arms.

Instead they held that the Constitution simply recognizes and protects an inherent human right: "it has always been widely understood that the second amendment , like the first and Forth Amendments, codifiies pre existing rights----the very text of the Second Amendment (without which the state would not have ratified the Constitition) and declares only that it no be infringed".


this is the broadestest interpretation we could possibly have hoped for, and mirrors the state metment of the Governor General of Massachussetts in 1757 whe he stated that " I know that you are as familiar with your arms as yoou are with your tools of trade and you may be called upon to use your arms in the defence of liberty."
